Recreational and sport sea fishing in Montenegro is subject to three basic documents.
The first and main document is Sea Fishing and Mariculture Act, dated August 14, 2009 (Zakon o morskom ribarstvu i marikulturi “Službeni list Crne Gore, broj 56/2009” od 14.8.2009. god.). In addition to the main provisions, the rules of recreational and sport fishing, the document regulates commercial fishing, governs the principles of breeding marine organisms and much more. The text is more than comprehensive, that’s why, adriaticnature specifies the excerpts from the document concerning the basic principles of regulating activities on the sea, and the ones that may deal with and deal with recreational and sport fishing. Further, adriaticnature will adhere to this principle, when posting all legislative acts.
The second document regulating recreational and sport fishing is Rules of Sport and Recreational Fishing on the sea, dated July 18, 2010 (Pravilnik o sportsko – rekreativnom ribolovu na moru. “Službeni list Crne Gore, broj 34/2010″od 18.6.2010. god.). In 2010, additions and changes have been made to these rules.
The third document dealing with all fishing methods is Order on the Prohibition of Catching of Full-Grown Fish and Other Marine organisms, dated May 26, 2015 (Naredba o lovostaju uzrasnih klasa riba i drugih morskih organizama. “Službeni list Crne Gore, broj 26/2015” od 26.5.2015. god.). The inhabitants of the sea, which are forbidden to be caught, are specified in this document. The document is a little strange, since some fish species listed in the Order don’t occur in the Adriatic or within the territory of Montenegro. But we are not the ones to judge. adriaticnature cites excerpts from it (the Order indicates including but not limited to the mammals and birds, but it seems that hardly anyone will catch whales and seals with a fishing rod with a cork float).
The fourth document, which is not a document at all, is the list of contacts of fishing clubs, where one can obtain a license for recreational fishing on the sea. adriaticnature is aware of a few unpleasant situations that happened because foreign tourists didn’t know how and, most importantly, where they could get this permission. adriaticnature believes that this list of organizations should be readily available for law-abiding fishermen who want to fish in the beautiful Montenegrin Adriatic.
Reportedly, in the next months, the Act, addenda and supplements, will be changed. That’s why, we’ll post only the shortest important excerpts from it.

Article 19
Fishing is prohibited in the area of ports, port entrances and approaches to ports and anchorages.
In the area of ports, port entrances and approaches to ports and anchorages, fishing is allowed only if the port user got the consent of the port authority, and Marine Biology Institute approved fishing in these areas.
Fishing is permitted in the areas of channels and inland waterways, if it doesn’t interfere with navigating of ships and other floating crafts.
Fishing is prohibited at organized and marked out beaches from May 1 to October 1, from sunrise till sunset.
Article 21
It is forbidden to catch fish and other marine organisms using explosive, chemical or other substances that kill, stun or poison fish and other marine organisms. Besides, it is forbidden to pick up and sell the caught fish and other organisms obtained by such means.
It is prohibited to store explosive or chemical substances, the usage of which can cause killing, poisoning or stunning fish and other marine organisms, on floating crafts and on the seashores.
Article 22
In the process of commercial or sport and recreational fishing, it is prohibited to use diving equipment and a speargun, to store this kit on floating crafts, to float and store it on the coast.
The diving equipment, specified in clause 1 of this article, is considered to be all types of diving or similar devices, using which the diver can breathe underwater.
Article 26
In order to protect the rocky coast as a special use habitat, it is forbidden to catch, use in any way within the territory of Montenegro, and export the bivalve date mussels (Litophaga litophaga) – prstac, prstać, prstić (Serbian, Croatian).
Article 60
The license for sport and recreational fishing may be permanent (year-round) or temporary.
A permanent license for sport and recreational fishing is issued for the current calendar year. Less often, it is issued for up to 30 days.
A temporary license for sport and recreational fishing is issued to a person who is not a citizen of Montenegro.
Article 61
A fee is charged for the license for sport and recreational fishing.
Article 63
Sport and recreational fishing must not interfere with commercial fishing.
It is prohibited to store fishing gear and equipment for sport and recreational fishing on the floating craft without the license for sport and recreational fishing.
It is forbidden to transport spearguns near the coastline and store them on the floating crafts without the license for underwater hunting.
It is forbidden to be engaged in sport and recreational fishing using spearguns from sunset to sunrise.
It is forbidden for persons, who are under 16 years of age, to be engaged in sport and recreational fishing using spearguns.

Article 8
The fee for the license for sport and recreational fishing with a permanent (year-round) or temporary fishing permit is as follows:
1) permanent (year-round) license:
– for persons under 18 years of age – 5.00 €
– for persons over 18 years of age, with the permission to use any legally permitted fishing gear and equipment, except for spearguns – 20.00 €
– for persons over 18 years of age for fishing using sparguns – 40.00 €
2) temporary license:
– one-day license – 5.00 €
– up to 5 days – 10.00 €
– up to 10 days – 15.00 €
– up to 30 days – 30.00 €
Article 9
During the day, the license holder can catch and take not more than 3 kilograms of fish and other marine organisms, as well as one fish weighing more than 3 kilograms.
The restrictions, specified in clause 1, are not applied to caching of tuna or swordfish, and to the catch in weight, when sport fishing competitions are held and the license holder participates in them.
Article 10
Sport and recreational fishing on the sea can be carried out using the following fishing gear and equipment:
1) leger rigs “fishing line for bottom fishing”, except for a trotline or gear for trolling (“fishhook with artificial lure”), in amounts of less or equal to two, with a maximum 3 hooks on each one, which shouldn’t be less than 7 mm wide, and when catching with a fishing line with a pulley rig – at least 9 mm wide;
2) “fishing line for bottom fishing” in amounts of less or equal to 2 with hooks for hunting for cephalopods, using or without using a lamp up to 400 candelas;
3) two fishing rods, equipped with a maximum of 3 hooks each;
A person, who has reached the age of 18 years and has a permanent (year-round) license, in addition to the gear mentioned in clause 1 of this article, can also fish using the following equipment:
1) one speargun without the use of explosives;
2) one harpoon;
3) a spear, using or without using lamps up to 400 candelas, on fishing oared boats with the bottom, through which one can’t see water; and
4) one creel;
Fishing gear and equipment, specified in clauses 1 and 2 of this article, can be used while fishing on oared, motorized or sailing boats.
Article 11
A person engaged in sport and recreational fishing with a speargun can move in water and under water only on his/her own, without using equipment to breathe underwater.
During underwater fishing, a marker buoy, which is connected to the body of an underwater hunter by a rope, must be used.
